Program Description: The LEC and Environmental Law Society are co-hosting a Mock Supreme Court Argument on Climate Change from 4:00 PM – 5:30 PM on Tuesday, April 10, 2012 at Founders Hall Auditorium, George Mason University School of Law, 3301 Fairfax Drive, Arlington, VA 22201, to examine critical arguments from Native Village of Kivalina v ExxonMobil Corporation (663 F. Supp. 2d. 863).

This mock argument examines the two critical arguments from Native Village of Kivalina v ExxonMobil Corporation, namely, (1) whether plaintiffs in cases such as Kivalina have standing under Article III of the U.S. Constitution to pursue public nuisance claims under federal common law for damages allegedly caused by certain defendants’ “contributions” to global warming, and (2) whether such claims present non-justiciable “political questions” reserved to the Executive or Legislative branches of government.
