The Advanced Economics Institute for Judges on Torts and Products Liability will provide judges with a deep analysis of the economic foundations of tort law and some of the key areas where economic analysis plays a critical role in the development or application of tort doctrines and related legal rules. It will also examine the civil justice system’s relationship to remedying wrongs, supporting exchange, and encouraging innovation, along with the tradeoffs contemplated in legal rules.

Topics will include but not be limited to: the economic foundations of tort rules generally, including in nuisance, strict liability, and products liability; risk and risk analysis; tort law as a system of insurance; deterrence; the cost of accidents; the costs of prevention; liability’s relationship to investment and innovation; the role of causation and traceability as elements of tort liability; allocability and attribution as key elements of liability and the strict standards of proof associated with each; standards for liability; the relationship between torts and regulation; scientific evidence and the admissibility of expert testimony; public nuisance and other novel liability theories; consumer protection and UDAP laws; remedies; punitive damages; market share liability; nuclear verdicts; phantom damages; social inflation.
