Program Description: The introduction of “liberal discovery” into the Federal Rules of Civil Procedure (FRCP) was an important conceptual innovation; requiring parties to reveal relevant information should improve the speed and accuracy of dispute resolution. However, rather than promote the “just, speedy, and inexpensive determination of every action and proceeding,” as Rule 1 of the FRCP demands, some have argued that by allowing the requesting party to foist costs onto their opponent, the current discovery rules result in protracted, costly, and unjust litigation. 60 congressional staff members joined us for a discussion of the current federal discovery rules and proposed reforms that could allocate some of the burden of discovery from the producing party to the requesting party.
